of los angeles and long beach, california reopened today after port operators and the worker's union reached an agreement late tuesday. the union said it won new protections against job outsourcing. port officials said during the walkout, they were unable to move some $760 million worth of cargo a day. wall street had a day of ups and downs and investors watched economic reports and weighed chances for a fiscal cliff deal in washington. the dow jones industrial average gained more than 82 points to close at 13,034. but the nasdaq fell nearly 23 points to close at 2,973. the day's big loser was apple, down more than 6% over concerns that smart phone sales are lagging. former texas congressman jack brooks has died. he served 42 years in the house, and was in the dallas motorcade on november 22nd, 1963 when president kennedy was assassinated. hours later, brooks was on hand as vice president and fellow texan lyndon johnson was sworn in to the presidency. later, brooks helped author the 1964 civil rights act, and he drafted the articles of impeachment against president nixon. jack brooks

. democrats and the labor unions are bankrupting this state. if the democratic party is so good, then why are we bankrupt? don't you think it's time the unions, instead of spending billions of dollars on political campaigns give that money back to the membership so they can maybe pay their own wages and tax bears and people like me that live on fixed incomes don't have to be taxed out of our homes and lose the money we have worked hard to make? guest: you have worked hard. number one, i cannot comment on the california situation. i just don't know enough about it. reports are that things are starting to turn around a little over there. it's tough to pass a budget if when you have the fiscal majority requirement. second, how we got here, it's not unions. wages for americans have been going down the past 115 years. people are not keeping up with inflation. the average american worker has taken a 2011 pay cut when you compare what they made 10 years ago to what they're making now. -- $2000 pay cut. on the spending, i disagree with you. the republicans in congress in particular have opened up

out the rise of the soviet union and its intentions. president truman, my fellow missourian, and his staff glued together the containment strategy which stayed in effect through admiral -- excuse me, through general eisenhower's presidency and later until, as you know, the wall in berlin came tumbling down, and the soviet union imploded on itself. the strategy worked. after we get this solved, it's important that we glue together a national strategy. it's going to be different. there's not one single threat out there, but many. terrorism, force upon force, state against state challenges, and that's what we must do. and we must nurture those in the war colleges and in the state department who have that strategic vision, that ability to glue together a good strategy and make sure that it does come to pass. so i'm hopeful we can solve the problem, that the congress can come together as we did for many, many years in tough, tough, difficult choices. and if you watch the comedians from time to time, you will see larry the cable guy. and let me take a frame -- a phrase from him to the cong

in our great union. oh, my god. let me go to ted kennedy on that. ted, have you a disability. you lost a leg to cancer years ago. i've always admired how you've handled it. what does it mean to someone disabled, this bill, to an american? >> well, for disabled americans we feel the republican party have really turned their backs, because what this treaty sdshdo by the way senator kerry has been our xhamp onon this and so many other issues, so i commend senator kerry and senator lugar and the other senators who bucked the trend of the pressure in the right wing of this party to somehow mischaracterize this treaty. the treaty is simple. it simply says a disabled american, including disabled american veterans, are afforded the same rights overseas as they are here at home. which is why 21 leading veterans organizations, including the vfw, american legion, wounded warrior project, hardly left-wing organizations, have been strong backers of this treaty. in addition, as senator kerry knows, and has eloquently described so well, this treaty was also endorsed by the u.s. chamber of commerce.

for him. but within a week he was read the riot act by the unions and the aarp who will resist any meaningful changes to the entitlement spending programs that are now bankrupting our country. later this week i will outline a series of entitlement spending changes that could and should be supported on a bipartisan basis. the president told the american people that he wants a balanced approach. my hope is that the president comes forward on his own, with his own details on how he would fix the entitlement spending programs. and i mean real details on real proposals with real teeth. not the window dressing in the president's budget that even the democrats reject and have rejected in the past. the president has demanded a balanced approach. it is what he promised the american people, and it is what we republicans are prepared to give him. if the president wants to avoid going over the fiscal cliff, he can steer us away from it. special interests and his liberal base will no doubt cry foul, but they will follow him if he will lead. and i don't see the leadership, between you and me. no
